Do I need a Will or a Trust?

WILLS
A Will is a document that tells the Court what you want after you pass away. An attorney will take your Will to the Probate Court and a judge will examine it and follow the instructions. There are safeguards built into the Probate process to ensure that your Will wishes will be followed. Your beneficiaries will receive notification every step of the way.

TRUSTS
A Trust is a private document that your Trustee will administer after you pass away or when you become incapacitated. Because of the private nature of a Trust, it will not go through Probate. Here, some of the safeguards are taken away but the process can be much quicker. I recommend a Trust if you won property in another state or if you wish your beneficiaries to receive money over time instead of all at once.
